Terms of Use

1. Agreement to Terms

These Terms of Use govern your access to and use of the IWR (Income and Wealth Readiness) platform operated by DataNav Solutions, LLC ("DataNav," "we," "us"). By accessing or using IWR, you agree to these Terms. If you are using IWR on behalf of an institution, you represent that you are authorized to bind that institution.

2. What IWR Is, and What It Is Not

IWR is a behavioral financial readiness platform. It identifies how an athlete tends to make financial decisions, lets them practice realistic scenarios, and certifies demonstrated decision readiness. IWR results reflect behavioral patterns in simulated situations.

IWR is not financial, tax, legal, contract, investment, or compliance advice. Assessment results are not diagnostic, psychological, predictive, or eligibility-determining instruments. For specific decisions, consult the appropriate qualified professional.

3. Accounts and Access

• Individual (self-enrolled) accounts are for users 18 and older.
• Athletes under 18 may use IWR only through an institution and only with the consent required by that institution and applicable law.
• You are responsible for keeping your access code and credentials confidential and for activity under your account.
• Institutions are responsible for managing the staff and athletes they enroll.

4. Acceptable Use

You agree not to misuse the platform. You will not attempt to access data you are not authorized to see, reverse engineer the platform, scrape or copy proprietary content, share access credentials, or use IWR to harass or harm others.

5. Certification

IWR certification reflects that an athlete completed the readiness journey and demonstrated minimum decision-readiness competency based on their Career Path performance. Certification is not a guarantee of future behavior or financial outcomes. DataNav may adjust certification criteria over time to maintain the integrity of the credential.

6. Institutional Agreements and Pricing

Pricing, roster size, term, and service levels for institutional use are governed by a separate written Agreement between DataNav and the institution. Where these Terms conflict with a signed institutional Agreement, the Agreement controls for that institution.

7. Intellectual Property

IWR, FIRE Scout, Playbook Identity, and Career Path, along with the platform content, simulation scenarios, scoring methodology, and archetype framework, are proprietary to DataNav Solutions. Nothing in these Terms grants you ownership of DataNav intellectual property.

Institutions retain ownership of any compliance or policy documents they upload. By uploading them, the institution grants DataNav a limited license to process those documents solely to generate institution-specific simulation content. DataNav will not use uploaded documents for any other purpose.

8. Your Data

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms. Institutions retain ownership of their athletes' data and may request export or deletion consistent with their Agreement and applicable law.

9. Accessibility

DataNav is committed to making IWR accessible in line with the Americans with Disabilities Act (ADA) and Section 508, and is actively developing toward WCAG 2.1 AA. To request an accommodation, contact kelly@datanavsolutions.com.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DATANAV DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATANAV WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY FINANCIAL DECISION MADE BY A USER. IWR PROVIDES READINESS EDUCATION, NOT FINANCIAL OUTCOMES.

12. Indemnification

You agree to indemnify and hold DataNav harmless from claims arising out of your misuse of the platform or your violation of these Terms or applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, communicated to institutions. Continued use after an update means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules, except where a signed institutional Agreement specifies otherwise.
